Vos pretrial postponed until December

The pretrial for Michael Stean Vos, Jr., 18, of Holland, was once again postponed Monday morning in the Minnehaha County Courthouse in Sioux Falls.

The pretrial, originally scheduled for Sept. 18, had been postponed until Monday to allow Vos’s attorney, Cheri Scharffenberg, to review approximately 1,400 pages of medical records. When Vos and Scharffenberg came before Judge Peter Lieberman Monday, Scharffenberg said the records had been reviewed and asked that the pretrial be rescheduled for December.

That extra time, she said, would allow Vos to meet with a neurologist to determine if he has any lasting neurological problems from his injuries sustained during the one-vehicle crash that occurred on May 24 in Sioux Falls and led to the death of Zachary L. Blawat, 16, of Pipestone.

“We’re just trying to determine the degree of his injuries,” Scharffenberg said. “We need to do it to determine Michael’s health.”

Vos, who was driving the vehicle, faces one felony charge of vehicular homicide and two misdemeanor counts of DWI following the crash. Blawat was a passenger in the vehicle and died two days later at Sanford Medical Center in Sioux Falls from injuries sustained during the crash.

Vos faces a maximum sentence of 15 years in prison and a $30,000 fine for vehicular homicide and a maximum sentence of one year in Minnehaha County jail and a $2,000 fine for DWI.

No specific date has been set for Vos’s next appearance in court, but it is expected in mid-December.
