The following resolution is being published in regard to the matter of the City of Pipestone revesting itself with unused cemetery spaces in Old Woodlawn Cemetery purchased by A.M. Heck more particularly Block F, Lot 113, Graves 1-4 in Old Woodlawn Cemetery.
RESOLUTION 2022-56
A RESOLUTION AUTHORIZING THE CITY OF PIPESTONE TO ADOPT A POLICY TO REVEST ITSELF WITH TITLE TO CEMETERY LOTS THAT WERE CONVEYED BUT NOT USED FOR THE PURPOSE OF BURIAL FOR MORE THAN 75 YEARS.
WHEREAS, the Community Improvement Commission is a city commission; and WHEREAS, the primary responsibility of the Community Improvement Commission is to ensure the care and operation of the City’s cemeteries; and
WHEREAS, the Commission has, on occasion, become aware of instances where cemetery lots have been sold to individuals but the lots have never been used; and
WHEREAS, Minnesota Statute 306.242 authorizes a cemetery association incorporated in Minnesota to revest itself with title to part of a cemetery that was conveyed but not used for the purpose of burial for more than 40 years; and
WHEREAS, on April 1, 2005, the Community Improvement Commission voted to adopt a policy that would authorize the city to revest itself with title to a cemetery lot when more than 75 years have passed since the lot was conveyed but not used for the purpose of burial.
NOW, THEREFORE, BE IT RESOLVED, that the city approve the recommendation of the Community Improvement Commission to adopt a policy authorizing the city to revest itself with title to cemetery lots that were conveyed but not used for the purpose of burial for more than 75 years.
Passed and adopted by the City Council of the City of Pipestone this 17th day of October 2022.
