Permit approved for auto repair shop

Pipestone County Commissioners during their Oct. 28 meeting approved a conditional use permit allowing Caleb McElmurry to open an auto repair shop in the northwest quarter of Section 17 of Osborne Township north of Edgerton.

According to the permit application, the shop will be where Bos Tire Shop used to be. Pipestone County Zoning Administrator Kyle Krier said McElmurry planned to purchase the property from Dave Hulstein.

A conditional use permit was needed because general repair services are listed as a conditional use in agriculturally zoned land in the county’s zoning ordinance. The Pipestone County Planning Commission held a public hearing to take comments about McElmurry’s request for a permit on Oct. 27.

“We had one individual present at the hearing last night,” Krier told the Commissioners on Oct. 28. “The only concern was dust and a lot of that was associated with Diamond H horse arena. The planning commission discussed the dust issue and they didn’t feel that it was warranted to put a condition on for the dust, so they made the recommendation to the County Board to approved the conditional use permit as presented with the conditions that it be operated as proposed and that they meet all other federal, state and local requirements.”

Commissioner Dallas Roskamp said the individual who was concerned about the dust had contacted him that morning and he thought dust control should be required. Krier said the discussion by the Planning Commission was the dust issue should be worked out between McElmurry, Diamond H Acres and the nearby residents.

“One of the Board members said it’s not that expensive to put down the dust control,” Krier said. “They could do 1,000 feet or more, share the cost and it would be better, where if you put the condition on the conditional use then it would be Caleb’s responsibility to ensure that that’s put down.”

Krier said the McElmurry expected to have about 30 vehicles a month visit the shop and Commissioner Dan Wildermuth said he thought requiring McElmurry to apply dust control would be overly cumbersome based on that volume of traffic. The Commissioners approved the permit with no added conditions and Krier said he would notify the parties involved and tell them to work on dust control matter. Krier said he thought Diamond H Acres should pay for the majority of the dust control based on the amount of traffic to and from that facility.
